Delivery

Free UK deliveries on orders over £35

Delivery time between 2-5 working days.

We will confirm receipt of your order by email. We will confirm when your Goods have been dispatched by email. We deliver to most international address at highly competitive rates. For international orders carriage costs will be clearly shown when you select your delivery destination. We usually deliver orders the on next day delivery using Royal mail service. If the order reaches over £50 a door to door courier will be used to enhance the security and speed of your order. We do not normally deliver at the weekend.

Our regular couriers do not deliver to PO boxes or Forces addresses. Please contact us so we can arrange an alternative delivery method

JollySmith are responsible for ensuring that Goods are adequately packaged for safe transportation of Goods supplied. Where applicable the Customer is responsible for ensuring the safe onward transportation where JollySmith are delivering to any central distribution centre, holding warehouse or other such building, where the items will be split and transported onwards. JollySmith does not guarantee that any individual item’s packaging will be sufficient for onward transportation unless a specific agreement has been made when the contract is agreed. JollySmith reserve the right to make additional charges where such a requirement becomes apparent at a later stage.

Delivery charges
All product prices are ex-works.  Delivery charges are quoted separately. The cost of carriage shall be paid by the Customer.  The delivery cost is determined by destination and product typw, including any outer packaging as shall reasonably be required to ensure that no damage occurs during transit.  JollySmith reserves the right to select the transport company used and will endeavour to consistently seek the best possible price for the Customer insofar as this does not affect quality of service.  The Customer may use their own shipper and in this instance are responsible for all charges involved in collecting Goods from JollySmith premises.

Guarantee & Returns

If for any reason you are not entirely happy with your online purchase you may return it to us within 14 days of receipt. We will happily replace, exchange or refund your items.

All Goods returned must be as new. The responsibility for the return delivery, and costs lie with the Customer but are negotiable depending on the extent of the damage/fault. Upon return the Goods will be inspected and a refund made within  14 days.

Damaged Goods
Please report any damages or non-delivery immediately – no complaints for transit damage can be considered unless made in writing via email or via a phone call within 10 days of receipt of Goods. Any claim for damaged or defective Goods can only be entertained if the Goods are returned to JollySmith in their original packaging or similar suitable packaging to ensure sufficient protection in transit or if the Goods are made available for collection from the location to which they were originally delivered by JollySmith or its authorised agents.

Faulty Goods, warranties and liabilities
Subject to conditions and provided the total price has been paid by the due date for payment, JollySmith warrants that the Goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship. JollySmith will (at its own choice) either replace, repair, or give credit for Goods found to be faulty within JollySmith’s warranty period relevant to Goods of that type. Unless otherwise stated the standard warranty period for all Goods supplied by JollySmith will be 12 months from the date of purchase.

JollySmith will as far as possible endeavour to ensure that all Goods supplied are safe and compliant with any relevant standards with regard to the specific intended and stated use for the Goods. JollySmith cannot be held responsible for defects arising from misuse or mishandling of Goods. Any fault or damage to the Goods supplied should be reported to JollySmith immediately, failure to do so may affect the warranty.

The Customer will indemnify and keep indemnified JollySmith against all claims, proceedings, costs and expenses in connection with any third party claim based upon any allegation that the safety of the Goods (or materials or components comprised within the Goods or any Goods in which the Goods are incorporated) is not such as persons are generally entitled to expect, save where such deficiency in their safety was present at the time the Goods were dispatched to the Customer or its agents by JollySmith or its agents.

Terms of trading

All orders are accepted subject to these terms and conditions of sale current as at the date of the order.

Retention of title
All products supplied to the Customer byJollySmith, shall remain the sole and absolute property of JollySmith, both in law and equity until the Customer shall have paid to JollySmith the agreed price, together with the full price of any other products supplied by JollySmith, pursuant to any other contract between them. The Customer’s right to possession of the products shall cease if it does anything or fails to do anything which would entitle a receiver to take possession of any assets or which would entitle any person to present a petition for winding up (or in case of a person or firm commit an act of bankruptcy). Notwithstanding the retention of property by JollySmith in accordance with the above provisions, all products supplied by JollySmith shall be at risk of the Customer as soon as they are delivered to the Customer’s premises or otherwise to order. The Customer shall hold any proceeds of sale as a fiduciary until its account with JollySmith is settled.

Changes to terms
Our terms are variable and subject to change without notice. JollySmith reserve the right to vary these terms from time to time as we see fit. Furthermore these terms may be withdrawn without notice and may vary from contract to contract.

Retailer Terms

JollySmith offers to work with retailers on all levels.

Drop-Shipping

JollySmith are happy to work with retailers that work on a drop-shipping basis only. The terms are standard with 40% the retail price excluding delivery charges. We offer a great service and aim to have our goods delivered on the next working day if the order is placed before 5pm. JollySmith always ensure that the products are well packed and use first class delivery to ensure safety and speed on delivery.

Sale or Return

JollySmith are happy to work on a sale or return basis only on the terms that an order will be placed after testing the product within the retail store. No more than a minimum order quantity will be provided on sale or return.

Wholesale

Orders will be accepted strictly on a proforma basis. Any applications for credit will be considered only if accompanied by acceptable trade references. If payment is not made by the due date credit terms may be withdrawn.

Exclusivity

The Customer does not have exclusive distribution rights of JollySmith products in any territory, unless specific terms have been agreed in writing.  Such an agreement will not be considered until a trading relationship has been established.  Further information about JollySmith policy on exclusivity agreements can be obtained upon request.
